Welcome to MediLean AI! These Terms of Service ("Terms") govern your access to and use of the MediLean AI mobile application, web application, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you don't agree to these Terms, please don't use the Service.

1. No Medical Advice

**MediLean AI is not a substitute for professional medical advice, diagnosis, or treatment.** The information provided by MediLean AI, including diagnostic suggestions, recommendations, and general health advice, is for informational purposes only and shouldn't be considered medical advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you've read or received from MediLean AI.

2. Your Use of the Service

  • Eligibility: You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you're at least 18 years old.
  • Account Registration: To access certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You're responsible for safeguarding your password and for all activities that occur under your account.

  • 3. Health Provider Integration (For Health Providers)

    For health providers utilizing the MediLean AI integration:

  • Data Integration: You're responsible for ensuring that any integration of MediLean AI with your existing systems complies with all applicable privacy laws and regulations, including but not limited to HIPAA or local equivalents in Kenya.
  • Quality Audit, Note-Taking, Recommendation Assistance: The tools provided are intended to assist health professionals and enhance operational efficiency. They aren't intended to replace professional judgment or established medical protocols.
  • Lab and Clinician Interfaces: You're responsible for the proper and secure use of these interfaces and for maintaining the confidentiality of patient data accessed through them.
  • Chronic Condition Management and General Health Well-being: The features assisting with these areas are supplementary tools and should be used in conjunction with comprehensive patient care plans.
  • 4. Intellectual Property

    All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, and software, are the exclusive property of MediLean AI and its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally permitted through the normal functionality of the Service.

    5. Disclaimer of Warranties

    The service is provided “as is” and “as available,” without any guarantees of any kind, either express or implied. While we strive to offer a reliable and helpful experience, Medilean AI makes no warranties regarding the accuracy, reliability, or suitability of the service for any particular purpose. We cannot guarantee that the service will always be uninterrupted, secure, or free from errors.

    Medilean AI and its affiliates, licensors, service providers, and team members are not liable for any damages that may result from your use of—or inability to use—the service. This includes, but is not limited to, direct or indirect damages, loss of income, data, business opportunities, or personal well-being. We are not responsible for any losses, whether caused by system errors, service interruptions, negligence, or other unforeseen issues, even if we were advised such issues could occur.

    You agree to defend, indemnify, and hold harmless MediLean AI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Contributions, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

    8. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in Nairobi, Kenya.

    9. Changes to Terms

    We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
